Terms of Service

Please read these Terms of Service (“Terms”) carefully before using coatclass.com (the “Site”) or purchasing any product offered through the Site (“Products”). By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Site or place an order.

1. Acceptance of Terms

Your access to and use of the Site constitutes your agreement to these Terms. We may update these Terms at any time by posting a revised version on the Site and updating the “Last updated” date. Material changes will be communicated by a prominent notice on the Site. Continued use of the Site after any change constitutes your acceptance of the revised Terms.

2. Seller Information

The Site is operated by HeroFitBox UG (haftungsbeschränkt), a limited liability company organized under the laws of the Federal Republic of Germany, with its registered office at In den Sümpfen 13, 56414 Weroth, Germany (“we,” “us,” or “our”). 3. Eligibility

You must be at least 18 years old to place an order on the Site. By placing an order, you represent that you are at least 18, that you are a legal resident of the United States or another jurisdiction we ship to, that the payment information you provide is accurate and authorized for your use, and that you are not placing an order for resale without our prior written consent.

4. Products

Our Products are pet care formulations intended for cosmetic external use on healthy pet coats only. Our Products are not medications, are not intended to diagnose, treat, cure, or prevent any disease or veterinary condition, and are not a substitute for professional veterinary care. Always consult your veterinarian before use if your pet has any medical condition, allergy, broken or irritated skin, or other health concern. Discontinue use and consult your veterinarian immediately if irritation, excessive licking, adverse reaction, or other concern occurs. Individual results vary by pet, breed, coat type, and application method; no specific outcome is guaranteed.

5. Pricing & Availability

All prices are listed in US Dollars (USD) and exclude applicable US state and local sales tax, which is calculated and added at checkout where required by law. We reserve the right to change prices, product descriptions, or availability at any time without notice. In the event of a pricing or descriptive error, we reserve the right to cancel any order placed under such error and issue a full refund. We are not obligated to honor a clearly erroneous price.

6. Orders, Acceptance & Cancellations

Your submission of an order constitutes an offer to purchase. Order processing is automated and begins immediately upon submission. We reserve the right to accept, decline, or limit any order for any reason, including suspected fraud, errors in pricing or product information, stock limitations, or violations of these Terms. Cancellation requests are not guaranteed — once our fulfillment system has begun preparing an order, cancellation may not be possible. A binding contract of sale is formed when we dispatch your order for shipment.

7. Payment

Payment is processed by third-party payment processors (including Stripe, PayPal, and Shop Pay). By providing payment information, you authorize a charge for the full order amount including applicable tax, shipping, and any optional add-ons (such as the coatclass Replacement Promise) selected at checkout. You represent that the payment method belongs to you and that you are authorized to use it. We do not store full card numbers on our servers.

8. Shipping & Returns

Shipping terms are governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy, including our 60-Day Satisfaction + Quality Promise. Both policies are incorporated into these Terms by reference. In case of conflict between those policies and these Terms on a matter of returns or shipping, the respective dedicated policy controls.

9. Anti-Abuse, Fraud & Chargeback Policy

To protect our customers and our business, we maintain the following practices:

  • Evidence requirement. All quality claims must include clear photographs or video showing the alleged defect, damage, or issue. Claims without sufficient evidence may be declined.
  • Discretionary review. All claims are reviewed at our sole discretion. We reserve the right to request additional documentation before approving any claim.
  • Claim frequency limits. A customer may file no more than one (1) satisfaction return per ninety (90) day rolling period. Repeated quality claims from the same account or address will be reviewed for potential abuse.
  • Pattern detection. We monitor account activity for patterns consistent with abuse, including high-frequency claims, claims inconsistent with delivery records, and chargeback histories.
  • Chargeback disputes. Where a customer initiates a chargeback that we believe is unfounded, we will dispute it with documentation including order history, delivery confirmation, IP address, device data, customer communications, and photographic evidence.
  • Fraudulent claims. Filing fraudulent or knowingly inaccurate claims — including false damage claims, false non-delivery claims, or unauthorized chargebacks for goods received — may constitute mail fraud, wire fraud, or other offenses under applicable federal and state law, and may be reported to relevant authorities and payment processors.
  • Account suspension. We reserve the right to suspend accounts associated with fraudulent or abusive activity.

10. Intellectual Property

All content on the Site — including text, images, logos, branding, product photography, video, and software — is owned by us or licensed to us and is protected by copyright, trademark, and other applicable intellectual property laws. You may not copy, reproduce, distribute, modify, publicly display, or create derivative works from any Site content without our prior written consent. Nothing in these Terms grants you any rights in our intellectual property other than the limited right to access and use the Site for personal, non-commercial purposes.

11. User Conduct

You agree not to use the Site to: (a) violate any applicable law or regulation; (b) infringe any third-party intellectual property, privacy, or other rights; (c) transmit malicious code, scripts, or other harmful content or attempt to gain unauthorized access to our systems; (d) misrepresent your identity or affiliation; (e) interfere with or disrupt the operation of the Site or its infrastructure; (f) scrape, data-mine, or harvest content without our prior written consent; (g) submit false, fraudulent, or knowingly inaccurate claims, chargebacks, or refund requests.

12. Reviews & User Content

By submitting a review, photograph, video, or other user-generated content to the Site, you grant us a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify for display purposes, distribute, and publicly display such content in connection with the Site and our marketing materials. You represent that the content is your original work (or that you have all necessary rights to submit it), that it is accurate, and that it does not violate any third-party rights.

We will not materially alter the substance of reviews. Where a reviewer has a material connection to coatclass — including receipt of free or discounted products, employment or contracting relationship, or other incentive — that connection will be clearly disclosed in or adjacent to the review in accordance with the FTC's 2023 Endorsement Guides (16 C.F.R. Part 255). We will not suppress or remove negative reviews solely because they are negative, provided they comply with our content guidelines (no hate speech, false statements of fact, or private third-party information).

13. Disclaimers & Limited Express Warranty

EXCEPT AS EXPRESSLY SET OUT IN OUR REFUND POLICY (60-DAY SATISFACTION + QUALITY PROMISE), THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee any specific cosmetic outcome from product use; individual pet results vary. Our Products are not medications; no therapeutic or veterinary efficacy is warranted or implied. See Section 4 for full product disclaimer.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEROFITBOX UG, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR FRAUD, GROSS NEGLIGENCE, INTENTIONAL MISCONDUCT, PRODUCT LIABILITY UNDER APPLICABLE LAW, OR ANY LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. THIS LIMITATION DOES NOT AFFECT YOUR STATUTORY CONSUMER PROTECTION RIGHTS.

15. Indemnification

You agree to indemnify, defend, and hold harmless HeroFitBox UG and its affiliates, officers, directors, employees, and agents from and against any third-party claim, demand, loss, damage, liability, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your violation of any law or regulation; (c) your violation of any third-party right; or (d) your submission of fraudulent chargebacks or quality claims. This indemnification obligation does not apply to claims arising from our own negligence or intentional misconduct.

16. Dispute Resolution — Binding Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

Agreement to Arbitrate. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Products — including disputes about their formation, validity, interpretation, enforceability, breach, or performance — will be resolved by binding, individual arbitration rather than in court. This applies to all claims whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory.

Arbitration Administrator and Rules. Arbitration will be administered by JAMS or the American Arbitration Association (AAA), at the election of the claimant, under the applicable Consumer Arbitration Rules in effect at the time of the dispute. The arbitration will be conducted in the English language, with the seat of arbitration in Wilmington, Delaware, unless the parties mutually agree to a different location or format. The arbitrator shall have authority to award any relief that would be available in court on an individual basis.

Class Action Waiver. YOU AND HEROFITBOX UG AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. If a court finds this class action waiver unenforceable as to a particular claim, that claim shall be severed from arbitration and litigated in court, while the remaining claims shall proceed to arbitration.

Opt-Out Right. You may opt out of this arbitration agreement within 30 days of the date you first place an order on the Site by sending written notice to legal@coatclass.com with the subject line “Arbitration Opt-Out” and including your name, email address, and order number. If you opt out, either party may bring qualifying claims in small claims court, or in the courts specified in Section 17 below.

Exceptions. The following claims are not subject to arbitration: (a) claims for injunctive or other equitable relief to protect intellectual property rights; (b) claims that qualify for small claims court (where the amount in controversy does not exceed $10,000 and the claim is not part of a class action). Either party may bring such claims in the appropriate court without first seeking arbitration.

Informal Dispute Resolution. Before initiating arbitration, each party agrees to attempt to resolve the dispute informally by notifying the other in writing and attempting good-faith negotiation for at least 30 days. Notice to us should be sent to legal@coatclass.com with the subject “Dispute Notice.”

17. Governing Law & Jurisdiction (International and Non-US Customers)

For US customers, the arbitration agreement in Section 16 takes precedence over the choice of forum in this section. For customers outside the United States who opt out of or are not subject to the arbitration clause, these Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-laws principles, and any dispute shall be brought before the competent courts of Westerwaldkreis, Germany. For all customers: this choice of law does not deprive you of any consumer protection rights granted by mandatory law of your state or country of residence that cannot be waived by contract.

18. Force Majeure

We will not be liable for any delay or failure to perform our obligations under these Terms where such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, fire, flood, storms, earthquakes, pandemic or epidemic disease, government orders, war, civil unrest, terrorism, labor disputes, power outages, failure of telecommunications infrastructure, or disruption to carrier or logistics networks. In such events, we will take reasonable steps to mitigate the impact and will communicate anticipated delays to affected customers. Our obligations will be suspended for the duration of the force majeure event, and any delivery estimates will be extended accordingly.

19. Subscriptions & Auto-Renewal

We do not currently offer subscription or auto-renewal products. If we introduce subscription plans in the future, we commit to providing clear disclosures prior to the first charge and before each renewal, consistent with applicable US auto-renewal disclosure laws including California, Arizona, New York, and Wisconsin requirements. Any future subscription service will: (a) clearly disclose the recurring charge amount and frequency before purchase; (b) provide at least 7 days’ advance notice before any material change to subscription terms or pricing; (c) offer a straightforward, single-step cancellation mechanism accessible through your account settings or by emailing support@coatclass.com. We will update these Terms before launching any subscription offering.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions will remain in full force and effect. The invalidity of one provision does not affect the validity of the remaining Terms.

21. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement between you and HeroFitBox UG with respect to your use of the Site and purchase of Products, and supersede all prior communications, proposals, or agreements between the parties on these subjects.
